1. Acceptance of Terms

These Disclaimer & Terms of Use govern access to, registration with, enrolment in, purchase from, participation in, and use of PEVCO Academy programmes, learning services, assessments, certificates, digital platforms and related services.

By accessing, registering with, purchasing from, enrolling in, or using PEVCO Academy, the learner, organisation, employer, sponsor or other user agrees to these Disclaimer & Terms of Use.

If a user does not agree with these terms, the user must not purchase, enrol in, or use the Academy services.

Where an organisation purchases or sponsors training for its personnel, the organisation is responsible for ensuring that participating personnel are informed of and comply with these terms.

2. Nature of PEVCO Academy

PEVCO Academy provides professional education and training programmes in inspection, testing, certification, technical and related professional subjects.

The Academy provides training for professional knowledge, understanding and continuing development.

3. Training Certificates

Upon successful completion of the applicable programme requirements and final assessment, PEVCO Academy may issue a digital certificate of completion.

The certificate will include an issue date and expiry date where applicable.

Certificate validity confirms the learner's successful completion of the applicable Academy training and assessment requirements during the stated certification period. It does not independently represent continuing professional competence, statutory authorisation or regulatory approval.

PEVCO Academy may provide an online certificate verification facility to enable third parties to verify certificate information.

4. Certificate Expiry and Re-enrolment

Upon expiry of a certificate, the associated training recognition for that certification period will cease.

A learner wishing to continue training recognition may be required to:

• Re-enrol in the applicable programme.
• Complete the required training again.
• Complete the applicable knowledge checks and learning activities.
• Successfully complete the final assessment.
• Satisfy any other requirements applicable at the time of re-enrolment.

5. Programme Content

PEVCO Academy develops its training material for professional educational purposes.

Training material may include international standards, industry practices, regulatory concepts, technical methods, professional guidance, case studies and practical examples.

Where external standards, regulations, contractual requirements or jurisdiction-specific requirements apply, learners must consult the current authoritative source applicable to their work.

Training material must not be interpreted as reproducing or replacing the complete requirements of any external standard, regulation, law, contract, specification or statutory instrument.

PEVCO Academy may update, revise or improve programme content from time to time.

6. Jurisdiction and Regulatory Requirements

Inspection, testing, certification, product conformity, vehicle inspection, mineral inspection, marine activities, occupational safety and other technical activities may be regulated differently between countries and jurisdictions.

A learner is responsible for determining the legal and regulatory requirements applicable to the jurisdiction in which they work.

PEVCO Academy does not represent that completion of a particular course automatically satisfies every regulatory or employer competency requirement in every African country or other jurisdiction.

Where local law imposes requirements that differ from Academy training material, the applicable law and competent authority requirements take precedence.

7. Professional Responsibility

PEVCO Academy training is educational in nature.

Learners remain responsible for how they apply the knowledge acquired through the Academy.

Nothing in Academy training authorises a learner to:

• perform an activity for which they are not legally authorised;
• represent themselves as accredited when they are not;
• issue statutory certificates without the required authority;
• override applicable legislation or regulatory requirements;
• disregard employer procedures;
• disregard client requirements;
• disregard applicable safety requirements;
• make technical conclusions beyond their competence, assignment or available evidence.

8. No Guarantee of Employment or Commercial Outcome

Completion of a PEVCO Academy programme and issuance of a certificate do not guarantee employment, promotion, appointment, professional registration, regulatory approval, accreditation, client acceptance, income, business opportunities, or any particular commercial or professional outcome.

Any employment, appointment, registration, licence, approval, accreditation or engagement remains subject to the requirements and decisions of the relevant employer, client, regulator, authority, professional body or other applicable organisation.

9. Accuracy and Professional Judgement

PEVCO Academy makes reasonable efforts to develop accurate and professionally relevant training material.

However, technical standards, legislation, regulations, industry practices, contractual requirements and other requirements may change.

Learners should verify current requirements before applying training material to a live professional assignment.

PEVCO Academy shall not be responsible for professional decisions made solely on the basis of training material without consideration of the applicable current requirements.

10. Online Learning and Technology

The Academy is delivered through online systems and therefore depends on internet connectivity, compatible devices, hosting services, email services and other technology.

PEVCO Academy does not guarantee uninterrupted or error-free availability of the platform.

The Academy may temporarily suspend or restrict access for:

• maintenance;
• security updates;
• technical problems;
• system upgrades;
• investigations;
• circumstances beyond reasonable control;
• other legitimate operational reasons.

11. Learner Account

Each learner is responsible for maintaining the confidentiality of their account credentials.

A learner must not:

• share account credentials;
• allow another person to complete training using their account;
• impersonate another learner;
• submit work on behalf of another person;
• attempt to manipulate assessment results;
• interfere with Academy systems;
• circumvent access controls.

12. Assessments and Academic Integrity

Final assessments are intended to establish whether the learner has achieved the required level of understanding for the applicable programme.

Learners must complete assessments honestly and independently unless the assessment expressly permits collaboration or other assistance.

PEVCO Academy may invalidate an assessment result or certificate where there is credible evidence of:

• impersonation;
• unauthorised assistance;
• assessment manipulation;
• account sharing;
• fraudulent activity;
• other serious academic misconduct.

13. Fees and Payments

Programme fees are displayed on the Academy platform at the time of purchase.

A learner's access to paid training, where applicable, is subject to successful payment confirmation.

Where a transaction fails, is reversed, disputed, cancelled or otherwise not confirmed, access may be suspended until the payment issue is resolved.

PEVCO Academy may update programme fees from time to time. The applicable price at the time of confirmed purchase will normally apply to that transaction.

14. Refunds and Cancellation

Refunds, where applicable, are subject to the Academy's applicable refund policy and the circumstances of the transaction.

Because online training may provide immediate access to digital educational material, refund eligibility may be affected once substantial digital content has been accessed or consumed.

Nothing in this section limits any mandatory consumer rights that may apply under applicable law.

15. Intellectual Property

PEVCO Academy course material, lesson content, assessment questions, explanations, graphics, branding, certificate designs, website content and other Academy materials are protected by applicable intellectual-property laws.

Unless expressly authorised, users must not:

• reproduce complete courses;
• redistribute lesson material;
• sell Academy content;
• publish assessment question banks;
• share examination materials;
• copy substantial portions of course content;
• create competing training products from Academy material;
• remove copyright, ownership or identification notices.

16. Confidentiality of Assessments

Final examination questions and assessment materials are controlled Academy content.

Learners must not publish, distribute, sell, reproduce or otherwise disclose examination questions or answer keys.

PEVCO Academy may change assessment questions, question banks, examination methods and assessment controls without prior notice where reasonably necessary to maintain assessment integrity.

17. Certificate Verification

PEVCO Academy may provide an online certificate verification service.

Verification information may include information necessary to confirm the authenticity and status of a certificate, such as:

• certificate number;
• learner/certificate name;
• programme;
• issue date;
• expiry date;
• completion status;
• certificate status.

18. Privacy and Personal Information

PEVCO Academy collects and processes personal information necessary to operate the Academy, including account registration, enrolment, payment, learning progress, assessment, certification, verification, security and customer support.

Personal information will be handled in accordance with applicable privacy and data-protection requirements and the Academy's applicable Privacy Policy.

Learners must ensure that information submitted to the Academy is accurate and belongs to them or is provided with appropriate authority.

19. Employer and Organisation-Sponsored Training

Where an organisation purchases or sponsors training for employees, contractors or other personnel, the organisation may receive appropriate administrative information relating to participation, completion or certification, subject to applicable privacy requirements and the agreed training arrangement.

The organisation remains responsible for determining whether a learner's Academy training satisfies its own internal competency or appointment requirements.

20. Third-Party Standards and Organisations

PEVCO Academy training may refer to standards, regulatory frameworks, professional organisations, industry practices or other third-party materials.

Reference to an organisation, standard or framework does not necessarily mean that the organisation has endorsed, accredited, certified or approved PEVCO Academy or the particular programme.

Where applicable, the Academy will identify the relevant framework or source for educational purposes.

21. Limitation of Liability

To the extent permitted by applicable law, PEVCO Academy shall not be liable for indirect, incidental, consequential or commercial losses arising from:

• use or inability to use the Academy;
• reliance on training material without checking applicable current requirements;
• professional decisions made by a learner;
• regulatory or employer decisions;
• loss of employment or business opportunities;
• interruption of online services;
• unauthorised use of a learner's account.

22. Suspension or Termination

PEVCO Academy may suspend or terminate an account where there is reasonable evidence of:

• fraud;
• academic misconduct;
• account sharing;
• unauthorised access;
• abuse of the platform;
• payment fraud;
• violation of intellectual-property rights;
• serious violation of these Terms.

24. Governing Law

These Terms shall be governed by the laws applicable in the Republic of Kenya, unless another governing-law arrangement is expressly agreed in writing for a specific organisational or contractual engagement.

Any dispute shall be addressed through appropriate communication and resolution procedures before formal proceedings are initiated where reasonably practicable.
